Tailings Management Moves From Technical Oversight to Core Mining Risk

Tailings management has shifted from a technical engineering function buried in technical reports to a central issue in corporate governance, financing decisions and legal risk across the mining sector. Regulatory frameworks, court rulings and closure obligations are increasingly placing tailings facilities at the center of operational, environmental and financial scrutiny.

Global standards redefine tailings facility accountability

The Global Industry Standard on Tailings Management (GISTM) was developed to reduce catastrophic failures and improve safety across mine waste storage systems worldwide. According to UNEP, the standard is designed to prevent catastrophic tailings dam failures and strengthen safety outcomes, while ICMM states that it governs the full lifecycle of tailings facilities from site selection and design through operation, monitoring and closure.

The lifecycle approach extends risk assessment beyond active production phases. Tailings risk now includes geological conditions, water balance assumptions, design integrity, construction quality, governance systems, emergency response procedures, community communication, closure planning and long-term post-closure monitoring.

BHP and Vale face long-term liability in Samarco case

Legal exposure from tailings failures is illustrated by the Samarco dam collapse in Brazil, operated by Samarco, a joint venture between BHP and Vale. Reuters reported that London’s Court of Appeal refused BHP permission to appeal a UK ruling holding it liable for the 2015 Fundão dam collapse.

The collapse occurred in Mariana, killed 19 people, displaced thousands and caused extensive pollution of the Doce River. The case is now proceeding toward damages assessment. The ruling highlights that tailings failures can generate cross-border legal liability long after the original incident, with exposure extending beyond operating entities to parent companies and joint-venture partners listed in international markets.

Closure obligations persist at Cobre Panamá

Tailings and environmental management obligations also extend beyond mine closure, as demonstrated by First Quantum Minerals’ Cobre Panamá copper mine. Panama authorized the company to process stockpiled ore from the closed operation to reduce environmental risks, including acid rock drainage, and to support management of the tailings facility. First Quantum stated that the activity does not constitute a mine restart and does not involve new mining or drilling.

The case underscores that suspended or closed mines may still require active tailings management, water control systems, environmental mitigation and workforce deployment, all of which carry ongoing operational and financial implications.

Permitting disputes highlight waste management risk

In Norway, the Nordic Mining Engebø rutile and garnet project illustrates how permitting linked to waste discharge can determine project viability. Reuters reported that Norway’s Supreme Court ruled that the project’s discharge permit was invalid, requiring reassessment by the state.

Although Engebø is not a large conventional tailings dam case, the ruling reinforces that waste and discharge management approvals remain central to project advancement in mining jurisdictions.

Tailings risk reshapes investor and lender due diligence

The increasing legal, environmental and operational complexity of tailings management is driving stricter due diligence requirements across the mining finance ecosystem. Investors and lenders are placing greater emphasis on disclosure of tailings facilities, consequence classification, adherence to GISTM standards, independent technical reviews, water balance modelling, emergency response planning and closure cost estimation. Additional scrutiny is being applied to historical performance factors such as seepage events, overtopping risk, seismic exposure and permitting disputes.

Financing structures are also adjusting, with tailings governance influencing cost of capital, loan covenants and access to sustainability-linked investment mandates.

Governance shift elevates tailings to board-level responsibility

The role of tailings management has expanded from engineering departments into corporate governance structures. Boards are increasingly expected to maintain direct oversight of tailings risk, while management accountability frameworks are being strengthened to ensure ongoing monitoring and compliance.

The sector-wide shift reflects a broader reassessment of mining risk, where tailings is no longer treated as a technical operational detail but as a core determinant of financial performance, regulatory approval and long-term corporate liability.
