Environmental Groups Challenge EU’s Strategic Designation of Lithium Mine in Portugal

Environmental and community organizations have initiated legal proceedings against the European Commission, contesting its classification of a lithium mine in northern Portugal as “strategic.” The lawsuit, brought forth by Associação Unidos em Defesa de Covas do Barroso (UDCB) and ClientEarth, claims that the Commission has overlooked significant environmental, social, and safety concerns associated with the Barroso lithium project.

The plaintiffs are aiming to annul the EU’s endorsement of the mine and seek clarification regarding the Commission’s responsibilities under the Critical Raw Materials Act, which is aimed at ensuring sustainable access to vital raw materials such as lithium, cobalt, and nickel by 2030. This legislation was implemented to support Europe’s green and digital transitions.

The Barroso mine is notable for being Europe’s largest spodumene deposit, boasting over 39 million metric tons. It was included among 47 projects labeled as “strategic” in March 2025, a designation that facilitates expedited development by simplifying permitting processes and enhancing financing opportunities.

Critics of this fast-tracking approach argue that it prioritizes expediency over environmental safety. Nik Völker from MiningWatch Portugal has expressed concerns that such a designation could lead to environmental degradation and adversely affect local communities while neglecting the economic uncertainties surrounding lithium mining and the disjointed nature of Europe’s battery supply chain.

<pPrevious requests from MiningWatch Portugal, UDCB, and ClientEarth to remove the Barroso project from the strategic list were dismissed by EU officials. The Commission has asserted that compliance with environmental regulations regarding water management, biodiversity protection, and tailings disposal falls under Portugal's jurisdiction.

This legal action underscores the potential environmental and social risks associated with labeling the Barroso project as strategic. The lawsuit argues that this classification contradicts EU legal principles by ignoring documented threats to water resources, ecosystems, human health, and local livelihoods. Advocates for sustainable practices assert that the energy transition must adhere to legal standards and scientific evidence rather than relegating rural areas to become “sacrifice zones.” Recently, Barroso’s lithium operations received €110 million ($130 million) in government funding, highlighting their perceived strategic importance for Europe’s ambitions in battery production and electric vehicle development.

Lithium is a critical component for electric vehicles, portable electronics, and energy storage systems. The extraction process at Barroso relies on spodumene mining—a method that is distinct from brine extraction but still heavily reliant on water resources.

The environmental implications of this extraction method are significant, including risks of aquifer depletion, chemical pollution, and disruption to local ecosystems. Communities nearby are increasingly concerned about potential impacts on drinking water supplies, agricultural viability, and biodiversity. These worries raise questions about whether rapid project development can genuinely align with sustainable supply chain objectives.

The ongoing case at the European Court of Justice will serve as a pivotal test of how the EU reconciles its need for strategic mineral supplies with its commitments to environmental stewardship and social responsibility. Given lithium’s central role in Europe’s plans for electric vehicles and energy storage solutions, the ruling could have far-reaching implications for future project approvals, funding strategies, and overall governance of critical raw materials within the region.
